Pennsylvania does not impose arbitrary caps in car accident claims. Whatever your damages are, you may claim compensation for them. There are no limits on economic or non-economic losses in car accident lawsuits other than what your actual damages are.

The only exception is when the defendant is a unit of government. For cases against the Commonwealth of Pennsylvania, a $250,000 limit per person applies under PA law 42 § 8528. There is a one million cap total for all victims. The limit is for both economic and non-economic damages. When the defendant is a local unit of government, there is a $500,000 limit for all victims in the aggregate under PA law 42 § 8553.
